Mr. Augustine is a civil litigator and trial attorney focusing on transportation law and business litigation. He provides counsel, strategic planning and litigation for individuals and businesses in a broad range of industries. He has served as lead trial counsel on a wide range of cases in state and federal courts in Ohio, Kentucky and Illinois, including catastrophic trucking accidents, Carmack Amendment claims, non-competition and trade secrets litigation, contract disputes, account collection matters, product liability, retail, construction and insurance. He devotes a substantial portion of his practice to representing businesses in the transportation industry including trucking companies and freight brokers.  

Mr. Augustine’s experience includes jury trials and alternative dispute resolution including mediation and arbitration. He is also a regional coordinator of the Roetzel Emergency Response Team, providing immediate response capabilities and crisis management for a variety of transportation and industrial clients.  

Representative Matters

  • Secured a voluntary dismissal, without any payment, of all claims against a national trucking company and its CDL driver in a four-vehicle trucking accident case
  • Counsels, negotiates and litigates on behalf of freight brokers in all manner of cargo claims from the ordinary to the extremely complex, including stolen load, "hostage load," identity theft, and simple late delivery or product condition claims
  • Provides cradle-to-grave emergency response, liability management and litigation for catastrophic trucking accidents in Ohio and Kentucky
  • Secured a summary judgment for an international transportation company and its truck driver using a novel legal theory that an allegedly applicable Ohio Statute was unconstitutional as applied to firm clients because it violated the Commerce Clause of the U.S. Constitution; trial court granted summary judgment and the trial court's decision was upheld by Ohio's 12th District Appellate Court in a decision that could have significant implications for motor carriers and many other Ohio companies that operate in interstate commerce
  • Secured summary judgments on behalf of clients in wide range of cases including breach of contract, premises liability, trucking accidents, bad faith, fraud and negligence
  • Successfully defended a home oil delivery company in a case involving a spill of hundreds of gallons of fuel oil into a multi-million dollar home in an exclusive neighborhood in Cincinnati, Ohio
  • Secured dismissal of all claims against a provider of security services, in federal court involving allegations of tortious interference, civil conspiracy, and various alleged constitutional and Kentucky statutory violations
  • Successfully defended a putative class action lawsuit on behalf of a large residential commercial complex, including dismissal of lawsuits by 165 plaintiffs with alleged claims including fraud, conversion, statutory violations and punitive damages
  • Secured summary judgment on bad faith breach of contract claims in multi-million dollar disability insurance litigation
