Mr. Secrest's practice focuses on assisting clients with employment related matters, including representation through all stages of litigation and before state and federal agencies. He represents small and large employers on employment issues ranging from sexual harassment claims to alleged violations of the Fair Labor Standards Act (FLSA). His experience includes successful representation at the trial and appellate court levels, and has obtained numerous dismissals of complaints, grants of summary judgment and jury verdicts on behalf of clients. In addition to practicing employment law, Mr. Secrest represents food manufacturers in defense of food product liability claims.

Mr. Secrest also represents healthcare clients in false claims litigation and regulatory matters. He has experience counseling pharmaceutical clients on licensing issues and compliance with state and federal laws and regulations, including the Food, Drug and Cosmetic Act, Drug Quality and Security Act, and kickback and self-referral issues arising under Stark and state mini-Stark laws.

Representative Matters

  • Successfully defended a restaurant chain against claims of race and national origin discrimination in front of the U.S. Court of Appeals for the Sixth Circuit
  • Obtained summary judgment on behalf of a client on claims of gender discrimination, sexual harassment and retaliation, which was upheld by the U.S. Court of Appeals for the Sixth Circuit
  • Represent an international food manufacturer in product liability claims throughout the eastern U.S.
  • Regularly defend Fortune 500 food and household device manufacturers in product liability claims in multiple states
  • Successfully defended product liability claims for a cosmetic and household products manufacturer in multiple state courts
  • Lead litigation counsel for a food manufacturer in defending product liability claims throughout the U.S.
  • Defended food manufacturers in a U.S. Food and Drug Administration (FDA) investigation of wrongful labeling
  • Obtained dismissal of complaint on claim of retaliation, which was upheld by the U.S. Court of Appeals for the Sixth Circuit
  • Obtained directed verdict on claims of wrongful termination and gender discrimination
  • Obtained a defense jury verdict in favor of a hospital and food manufacturer on food product liability claims
  • Successfully represented a food manufacturer in defense of U.S. Department of Agriculture (USDA) investigation and prosecution of violations of handling of USDA product
  • Defended a food manufacturer against Perishable Agricultural Commodities Act (PACA) claims asserted by a produce supplier
  • Represented a food manufacturer in successful defense against a vegetable supplier in U.S. District Court seeking a temporary restraining orderand damages
  • Obtained dismissal of claims asserted by the USDA against a food manufacturer
  • Represented an international food franchisor related to claims for damages based on an adulterated food product
  • Successfully defended an international fast food franchisee on claims brought pursuant to Title III of the Americans with Disabilities Act (ADA)
  • Currently represent Ohio franchises regarding employment law issues
  • Defended a food franchisee for a personal injury claim based on an adulterated food product
