Ms. Ketler’s practice is focused on the acquisition, clearance, prosecution and licensing of trademarks, both domestically and internationally.  She represents clients in trademark and other intellectual property disputes, including numerous trademark opposition and cancellation proceedings at the Trademark Trial and Appeal Board of the US Patent & Trademark Office, and has handled a variety of trademark infringement, trade dress infringement, and patent litigation matters in federal court.

She has significant experience in managing large and complex international trademark portfolios, as well as in counseling clients on all aspects of trademark protection, policy and procedure.  In addition, she advises clients on copyright issues, handles and negotiates the resolution of copyright disputes and other intellectual property disputes, and provides clients with strategic analysis regarding the development and protection of their intellectual property rights. 

Ms. Ketler’s practice also includes negotiating, drafting, implementing and advising clients with respect to agreements affecting intellectual property rights, including trademark and copyright licensing and assignments.  She also negotiates, drafts and assists in the implementation of complex software licensing agreements, non-disclosure agreements and similar.  She has assisted small business clients with all legal aspects of setting up and launching online and internet-based businesses, and has handled all legal aspects of publishing and media production for clients’ creative endeavors. 

Ms. Ketler represents a wide variety of clients in these matters, including manufacturers, retailers, utility companies, financial companies, media companies, non-profit organizations, educational institutions and other large and small businesses.

• Represents clients, including manufacturers in various industries, retail companies, utility companies, educational institutions and small businesses in numerous trademark opposition and cancellation proceedings before the Trademark Trial and Appeal Board, achieving favorable and cost-effective settlement of most such proceedings
• Represented a tool manufacturing company in a federal court action involving trade dress infringement, trademark registration cancellation, false advertising, unfair competition and false patent marking claims; obtained favorable and cost-effective settlement for the client at the discovery stage
• Represented a utility company in a federal court action for trademark infringement, which resulted in prompt and efficient settlement that met all client demands and resulted in complete cessation of use of client trademarks by infringer
• Manages substantial portions of a large and complex international trademark portfolio for a large manufacturing company and advises client with respect to all trademark issues, including the clearance, prosecution and protection of trademarks
• Advised and represented a world-renowned health-care institution in the clearance, prosecution and protection of its trademarks, and managed the US trademark portfolio for that same institution
• Represented a media production company in the prosecution and protection of its famous trademarks worldwide, as well as in the worldwide protection and enforcement of its copyrights in its best-selling motion pictures and audio CDs
• Advised a major pharmaceutical company on the clearance and proper use of its trademarks
• Actively participated in the creation, drafting and implementation of privacy, security and document retention policies for a major transportation company
• Represented a variety of small businesses in the sale, assignment and licensing of domain names, trademarks and copyrights
• Represented a law firm client in the negotiation of numerous software and technology licensing agreements
