Mr. Cathey focuses his practice on business and commercial litigation, labor and employment, and creditors’ rights litigation. With more than 12 years of litigation experience, he is a trial attorney who regularly defends and prosecutes claims on behalf of banks, finance companies, equipment lessors, debt buyers, and other financial services providers in consumer and commercial disputes. In addition, he has substantial experience representing companies and individuals in a broad range of complex business litigation matters, including directors and officers liability claims, commercial real estate, employment disputes, and non-competition and trade secret litigation.
Representative Matters
- Summary judgment on behalf of a national bank in a federal putative consumer class action under the Fair Debt Collection Practices Act
- Dismissal of federal court action against two UK-based investment advisors arising from a $20 million european investment scheme
- After six years of litigation, including an appeal and remand, took over representation of national bank three months before trial, tried case to a favorable foreclosure judgment and prevented wrongful foreclosure action
- Summary judgment on behalf of auto financier in a consumer action under the Ohio Consumer Sales Practices Act
- Directed verdict resulting in dismissal of consumers' claims that sought to pierce the corporate veil against shareholders of mortgage brokerage
- Summary judgment on behalf of national bank in two state court actions brought in Huntington, West Virginia, asserting bad faith claims under credit card debt cancellation products
- Summary judgment on behalf of mortgage loan officer in consumer fraud case
- Summary judgment on behalf of convenience store chain in defense of employee's injury claims arising from the brutal attack of third-party assailant
- Summary judgment in federal court upholding equipment lessor's finance lease as a true lease rather than as a security agreement under the Uniform Commercial Code (UCC)
