Overview

Mr. Tackett is an experienced litigator that prides himself on identifying and executing creative solutions to resolve complex cases. He represents businesses in commercial litigation; all aspects of employment advising and litigation, including internal investigations of incidents and of discrimination charges filed with the EEOC and Ohio Civil Rights Commission; along with various types of administrative litigation before state and federal agencies, including those adjudicating employment matters and tax controversies. Mr. Tackett frequently handles commercial litigation matters involving contract disputes between businesses, contentious business breakups, claims for misappropriation of trade secrets, and disputes regarding alleged non-solicitation or non-compete violations between businesses and their former partners or associates. Also, Mr. Tackett has handled numerous cases involving class actions and other types of procedurally complex litigation, including as lead counsel defending a putative nationwide class action regarding alleged violations of the Telephone Consumer Protection Act (TCPA).

In the course of his business litigation practice, Mr. Tackett has represented companies throughout the country, and in state and federal courts all across Ohio. Additionally, he represents businesses in arbitrations, including those administered through the American Arbitration Association (AAA), through JAMS (Judicial Arbitration and Mediation Services, Inc.), and privately administered arbitration. Mr. Tackett has represented the interests of his clients before nearly every Ohio administrative agency. Also, he has represented clients in tax controversy matters in administrative and quasi-judicial forums before the Internal Revenue Service (IRS), the Ohio Department of Taxation, the Ohio Board of Tax Appeals, and the U.S. Tax Court.

Experience
  • Defending insurance administrator in trade-secret litigation regarding rate-setting systems. Handled briefing to obtain denial of the plaintiff’s motion for preliminary injunction.
  • Defending insurance administrator in Illinois-based complex commercial contract dispute litigation brought by coalition of 13 R.V. dealer groups regarding consumer refund obligations and underwriting profit sharing on vehicle service contract sales.
  • Defending insurance administration companies in putative New York-based nationwide class action regarding alleged third-party TCPA violations. Obtained indefinite stay after convincing the Court through briefing and oral argument that collateral estoppel barred the class representative’s claims.
  • Defending Ohio company in federal litigation brought by a former employee alleging Family Medical Leave Act (FMLA) interference and retaliation claims, along with novel FMLA-by-estoppel arguments.
  • Obtained temporary restraining order and permanent injunction on behalf of Ohio-based Fortune 500 manufacturing company to prevent armed and dangerous trespasser, who was a former contractor, from coming within one mile of the facility.
  • Successfully represented LLC members in highly contentious business breakup concerning a group of closely-held manufacturing and real estate businesses, in an instance with cross allegations of embezzlement and fraud. Obtained split-up of businesses and their assets and complete settlement of all allegations, along with substantial cash settlement for minority interest holders.
  • Handled briefing and argued before the 10th District Court of Appeals on an appeal of a trial court’s refusal to vacate a $1.3 million-dollar arbitration award despite the panel exceeding its authority.
  • Successfully handled investigation and response to multiple OCRC and EEOC employment discrimination charges.
  • Defended chiropractors against solicitation claims that the chiropractors’ prior practice filed, alleging $750,000 in damages. Obtained zero-dollar settlement after identifying misconduct by members of the former practice group and filing separate claims for breach of LLC member duties.
  • Represented buyer in breach of multi-million-dollar real estate contract; obtained freeze on sale to third-party, and secured settlement after handling briefing and hearing on injunction.
  • Represented ex-CEO of large Ohio company in administrative litigation before state taxing authorities of six states and obtained abatement of responsible party tax assessments in each instance.
  • Successfully represented Canadian taxpayer in U.S. Tax Court case regarding the IRS’s refusal to pay the taxpayer’s claimed refund of gambling jackpot withholdings under Form 1040-NR, and obtained $736,000 settlement for the full amount of the taxpayer’s claimed refund.
  • Represented an issuer of $4.5 Million dollars of notes in actions arising from failed securities law
    compliance, leading to substantial cash settlement.
  • Helped settle claims on behalf of a publicly-traded bank arising from its participation loan to fund a $500 Million construction project.
  • Represented a class of charitable donors in a nationwide class action. Achieved settlement, certification of settlement class, and final approval of class action settlement.
