As an experienced trial lawyer, Mr. Casto has represented a variety of clients in cases across the State of Ohio and throughout the United States. His no-nonsense, result-oriented approach to litigation has resulted in clients engaging him to represent them in various lawsuits across 22 different states. In addition to his success as a trial lawyer, Mr. Casto has been instrumental in upholding verdicts and reversing unfavorable decisions against clients in both the Court of Appeals and state Supreme Courts in Ohio, New Jersey, and Texas.

Throughout his career, Mr. Casto has represented manufacturers in the defense of various product liability trials on a state, regional, and national level. He has extensive experience defending companies involved in the design and manufacture of new and retreaded tires, machinery, power tools, industrial and agricultural equipment, and asbestos-containing products. He has also represented clients in commercial disputes as well as fiduciary litigation involving various matters concerning the interpretation, modification, and termination of trusts, estates, and wills. His clients in fiduciary litigation include financial institutions, trustees, beneficiaries, and remaindermen involving a variety of personal and charitable trusts.

Mr. Casto has also handled various types of business disputes involving shareholders and closely held companies. He has defended financial institutions in lawsuits involving various negotiable instruments under Articles 3 and 4 of the U.C.C. He also has experience in litigation concerning Automated Clearinghouse (ACH) transactions and the Operating Rules of the National Automated Clearing House Association (NACHA Operating Rules).

Representative Matters

  • Obtained defense verdicts on behalf of various tire manufacturers in jury trials held in both state and federal courts in multiple states
  • Lead counsel in the defense of a machinery manufacturer involving 10,000 asbestos cases in 7 states
  • Defended multiple cases involving breach of fiduciary duty claims involving corporate and individual trustees, trust reformation, modification and termination claims involving both charitable and individual trusts
  • Defended financial institutions in various claims involving Article 3 of the U.C.C. with respect to lost, stolen, and forged cashier’s checks and issues involving deposits and collections under Article 4 of the U.C.C
  • Defended multiple cases involving claims of negligence and breach of the Operating Rules of the National Automated Clearing House Association (NACHA Operating Rules) in the payment of Automated Clearinghouse (ACH) Transactions
  • Obtained a decision from the Texas Supreme Court that unfiled discovery documents are “court records” subject to a protective order under the Texas Rules of Civil Procedure. General Tire, Inc. v. Kepple, 970 S.W.2d 520 (Tex. 1998)
  • Obtained a decision from the New Jersey Supreme Court that unfiled discovery documents are subject to the terms of protective order between the parties in the case. Estate of Frankl v. The Goodyear Tire & Rubber Co. 853 A.2d 880 (N.J. 2004)
  • Obtained a decision from the Ohio Supreme Court that Ohio’s intentional tort statute could not be retroactively applied to pending cases against employers in the case of Kunkler v. The Goodeyar Tire & Rubber Co. 36 Ohio St. 3d 135 (1988)
