Ms. Lopez’s practice focuses on complex business and commercial litigation, intellectual property litigation, and general intellectual property law, with an emphasis on trademarks, trade secrets, and copyrights. Ms. Lopez works with businesses and individuals to navigate and manage existing and potential litigation needs in both state and federal courts. Though she has handled many types of complex cases, Ms. Lopez’s work often includes prosecuting or defending commercial disputes, including breach of fiduciary duty and contract claims related to closely held corporations, partnerships, and large and middle-market companies. She is well-versed in “spin-off” claims regarding corporate waste, zone of insolvency issues, and gross mismanagement of corporate funds. Ms. Lopez prides herself on the results she obtains for her clients, having successfully defended many clients facing major potential liability.

  • Defending limited liability company in federal court action involving copyright infringement claims
  • Defending law firm and several lawyers in state court legal malpractice lawsuit
  • Defending specialty jewelry retailer in state court action involving shareholder derivative claims for breach of fiduciary duty, abuse of control, gross mismanagement, and unjust enrichment
  • Representing closely held corporation in litigation involving confirmation of successful arbitration award and associated valuation process pertaining to removal of Officer and Director for breaches of fiduciary obligations
  • Defending limited partnership in dispute before the American Arbitration Association concerning declaration of rights under limited partnership agreement and counterclaims involving breaches of fiduciary duties and mismanagement of partnership assets
  • Representing casino and racetrack in administrative appeals before the Ohio Department of Health concerning alleged violations of Ohio’s Smoke-Free Workplace Act
  • National coordinating counsel for large automobile dealership in relation to maintenance and enforcement of intellectual property rights
  • Represented live harness & simulcast horse-racing track in federal litigation involving federal allegations arising under the Interstate Horseracing Act and federal antitrust laws
  • Represented an American power generation company in federal litigation involving warranty and indemnity claims for defectively supplied catalyst; successfully represented same entity in recent victory before the Sixth Circuit Court of Appeals
  • Represented a public utility holding company with respect to alleged legacy CERCLA liability related to defunct manufactured gas plants, currently on appeal before the Sixth Circuit Court of Appeals
  • Represented foreign tire company in federal patent litigation against global tire manufacturer
  • Successfully defended through motion to dismiss Swedish tool making company against patent infringement claims before the United States District Court for the Northern District of Ohio
  • Successfully defended with summary judgment victory national banking institute in probate litigation involving allegations of  breaches of the Ohio Uniform Prudent Investor Act
  • Represented directors and officers of former insolvent corporation under D&O policy to successfully defend claims for breach of fiduciary duties, corporate waste, zone of insolvency issues, and gross mismanagement of corporate funds
  • Represented global specialty retailer of crafts and fabrics in dispute with foreign corporation involving claims arising under the Uniform Commercial Code for the purchase of defective and non-conforming goods
  • Successfully represented a municipality in litigation involving inverse condemnation and private nuisance claims resulting from flooding of nearby waterways and subsequent property damage
  • Successfully represented banking institution in federal litigation involving the unauthorized sale of an aircraft
  • Represented advertising agency in defending trademark registration rights before the USPTO in relation to an office action denying registration based on a likelihood of confusion with prior registered mark
  • Successfully represented a commercial landlord in action for forcible entry and unlawful detainer, breach of contract, and unjust enrichment pertaining to the supply of petroleum products and associated lease of property
