Overview

Jonathan defends Ohio employers before the Ohio Bureau of Workers’ Compensation against workers’ compensation claims, including .512 and Mandamus Actions and Violation of a Specific Safety Requirement (VSSR) claims. He guides clients through post-administrative appeals filed in common pleas courts throughout Ohio: preparing pleadings, developing litigation strategy, deposing fact and expert witnesses, representing employers at jury trials, and negotiating and concluding settlements. He has particular strengths crafting Medicare Set-Asides. And he protects the rights of companies in Occupational Safety and Health Administration (OSHA) citations.

Clients depend on Jonathan’s skill and experience effectively and efficiently to protect their business interests and bottom line – effectively and efficiently – like the national retailer facing liability for a serious workplace accident. During the trial, Jonathan successfully demonstrated that the injured worker’s own negligence caused the accident, saving his client more than $70,000 for that claim alone. For another client, a national health insurance provider, Jonathan resolved multiple workers’ compensation claims filed by traveling nurses, then worked with the client to rewrite the employer’s internal safety handbook to reduce future risk for similar incidents.

On behalf of employers across Ohio, Jonathan monitors claims to identify and respond to post-allowance issues such as terminating compensation, claim reactivation, permanent partial disability claims, motions for additional conditions, permanent total disability claims, requests for surgery or additional medical treatment, and the necessity of continuing medical treatment.
