Overview

Nick focuses his practice on litigation, with an emphasis on liability defense in the retail and hospitality industries, which includes premises liability, products liability, consumer claims, negligent security and loss prevention violations. Throughout the State of Ohio, Nick represents many Fortune 500, national, and regional corporations. Nick strives to provide his clients with an aggressive defense when necessary, while simultaneously keeping business objectives at the forefront. Nick understands that his clients operate businesses, and he works to ensure that a vigorous defense is both cost effective and practical.

In addition to retail and hospitality, Nick has assisted clients in a wide array of matters and legal issues, including transportation litigation, wrongful death, negligent hiring, supervision, retention, business disputes, legal malpractice, consumer contracts, contracts under the Uniform Commercial Code, construction defects, subrogation, violations of the Ohio Consumer Sales Practices Act, and criminal violations. In tort litigation, Nick has successfully defended many catastrophic injury and wrongful death claims.

As an adjunct to his litigation practice, Nick also works closely with fellow Roetzel shareholder Thomas S. Zaremba to advise and represent clients relative to the development and implementation of building codes and product standards. Nick has experience appearing for proceedings before the International Code Council (ICC), ASHRAE (formerly American Society of Heating Refrigeration and Air Conditioning Engineers), and National Fenestration Rating Counsel (NRFC). With his experience as a litigator, Nick aggressively advocates to ensure that clients' interests, both financial and legal, are protected and advanced when faced with regulatory action.

Although a native of Southwest Ohio, prior to his legal career, Nick resided in Washington, D.C. and interned for then United States Representative and current United States Senator Rob Portman. He also worked for the United States Department of State Bureau of Diplomatic Security during the Condoleezza Rice administration.

Experience
  • Represents a Fortune 50 corporation in the handling of its Ohio retail stores' casualty, consumer contract, and subrogation matters, which includes multiple victories by way of summary judgment
  • Represents multiple Fortune 500 retailers throughout Ohio, which includes many victories by way of summary judgment, trial, and on appeal
  • Represented a Fortune 250 healthcare corporation concerning casualty and medical malpractice claims arising from its Northeast Ohio facilities
  • Resolved several wrongful death claims, each for less than $500,000.00, with two (2) resolutions below $100,000.00
  • Obtained summary judgment for a local security corporation on claims for wrongful death and traumatic brain injury
  • Advised a Cleveland, Ohio, passenger transportation corporation concerning casualties, drivers' torts and misconduct, and counseled the client as to best practices on driver retention, disciplinary matters, driver leasing agreements, and compliance with municipal transportation ordinances
  • Briefed the United States Supreme Court on the application of the 14th Amendment to a breach of contract matter, resulting in a success for the client when the Court denied Certiorari to the Petitioner
  • Briefed a matter before the Ohio Supreme Court that resulted in a win for the client when the court denied jurisdiction regarding various tort claims
  • Briefed and successfully argued matters before various Ohio Courts of Appeals
