Overview
Glenn practices in the areas of commercial finance, bankruptcy, creditors' rights, and commercial litigation. His practice also includes structuring and documenting complex loan transactions in all areas of commercial real estate and business collateral. He has a sophisticated understanding of the restructuring landscape and provides comprehensive services in all aspects of restructuring and insolvency proceedings from preworkout phase through litigation, if necessary. He regularly represents a wide range of stakeholders, including investors and asset purchasers, committees, secured and unsecured creditors, parties dealing with distressed businesses, officers and directors, and other interested parties in restructurings, bankruptcy proceedings, and related litigation.
His clients include creditor groups of all kinds, including CMBS special servicers, financial institutions, private equity funds, and FDIC loss share participants. Glenn’s representation includes matters involving loan workouts, debt restructurings, debtor-in-possession financings, and enforcement of creditors’ rights. His experience crosses a broad array of industries, including finance, leasing, real estate, retail, resort and hospitality, franchise, and the food service industry.
In addition to his substantial practice in distressed transactions, Glenn has significant experience in tax credit projects. He regularly represents financial institutions and equity investors in LIHTC work. He has worked with local governments, state housing agencies, HUD officials, tax-exempt bond financing trustees, and parties to multi-tier debt and equity structures in sub-performing and non-performing affordable housing projects throughout the United States.
Experience
- Served as legal counsel to various banks, financial institutions, servicers, funds and domestic/foreign investors on the liquidation and restructuring of non-performing loans in excess of $2 billion; assignments involve leveraged financing with respect to residential construction financing, acquisition and development financing, commercial financing on retail and multifamily units, structured financing on hotel/condominium and stand alone condominium projects, and mezzanine and equity financing arrangements
- Represented a car manufacturer in a punitive class action removed to federal bankruptcy court and then settled for a nominal amount; defeated an objection filed by an unnamed class member to the settlement and compromise between the Chapter 7 trustee and the car manufacturer
- Represented a lender holding a $3.5 million claim in a Chapter 11 single-asset real estate case; obtained a dismissal of the bankruptcy case which allowed the client to foreclose its mortgage on the property
- Represented the committee of unsecured creditors in a matter involving $25 million in unsecured debt and $120 million in secured debt; participated in drafting a competing Chapter 11 plan which was approved by creditors and the bankruptcy court over the debtor's Chapter 11 plan
- Represented the committee of unsecured creditors as co-counsel concerning a national restaurant chain, resulting in the approval of the debtors' reorganization plan and a guaranteed dividend to the unsecured creditors in a case where the secured debts exceeded the value of the collateral
- Represented the creditor agent of the liquidating trust formed postconfirmation in a successful Chapter 11 bankruptcy case and handled over 60 lawsuits filed by the creditor agent seeking to avoid and recover transfers made to defendants as fraudulent conveyances and preferential transfers
- Represented an appellee/defendant before the Eleventh Circuit Court of Appeals concerning a lawsuit which was dismissed, with prejudice, for lack of subject matter jurisdiction by the bankruptcy court
- Represented tax credit syndicators and limited partnership investors in senior housing and affordable housing projects throughout the southeast US
- Served as counsel to the committee of unsecured creditors in the Chapter 11 reorganization of a grocery store chain with locations in Central Florida
- Served as counsel to the committee of unsecured creditors in the reorganization of a restaurant chain with locations throughout Florida
- Served as debtor's bankruptcy counsel on the reorganization of a publicly traded company and national restaurant chain
