As a construction attorney, Teresa represents owners/developers, general contractors and subcontractors in disputes arising from commercial, industrial and residential projects. She arbitrates and litigates matters involving construction agreements, unjust enrichment, mechanic’s liens and statutory violations and frequently handles claims related to nonpayment, poor workmanship, incomplete or incorrect work, defective construction, schedule delay, unapproved change orders, payment and performance bonds and mechanic’s liens. Teresa also advises her clients on course-of-construction related issues and negotiates construction contracts.
In addition to litigating matters on behalf of her clients in state and federal courts, Teresa has significant experience resolving matters through alternative dispute resolution, particularly arbitration. She frequently arbitrates construction and commercial disputes, typically before the American Arbitration Association (AAA). Teresa is a member in good standing on the AAA Panel of Construction Arbitrators and the AAA Panel of Consumer Arbitrators. According to the AAA’s website, “[t]he AAA Construction Panel is a carefully curated group of professionals with a proven track record in handling construction-related disputes. These arbitrators and mediators bring diverse, real-world experience to resolve conflicts efficiently and fairly.” Hands-on experience, practical problem solving and a focus on collaboration are what sets the Construction Panel apart.
Teresa also has significant commercial litigation experience, including business and bankruptcy related issues. In these contexts, she has represented small and large entities, trustees, and individuals in disputes such as those involving breach of contract, fraud, misrepresentation, breach of fiduciary duty and statutory violations. Representative matters involve breaches of master services agreements, operating agreements, co-location mining services agreements, hosting services agreements for cryptocurrency mining, distribution agreements, lease agreements, franchise agreements and trust agreements.
