Marc H. Kallish

Marc is a shareholder in the firm's Business Litigation Group and focuses his practice on complex disputes, employment litigation, class actions, products liability, catastrophic and wrongful death litigation, antitrust, railroad law and securities litigation.

He has developed a unique niche in taking over and turning around high-dollar, high-exposure litigation. He consults for, and often represents, insurance companies and corporate clients, helping them understand the strategic implications of ongoing litigation and whether options or actions are available or have been overlooked. His work and recommendations have resulted in millions of dollars in savings for clients. In some instances, based on this insight, companies have settled early or litigated more aggressively by pursuing new, previously unasserted claims, joining third-parties and other activities.

Experience

• Represented a national LTL trucking company in a jury trial against a global online retailer in the U.S. District Court for the Western Division of Washington, resulting in multi-million dollar jury award for the client.
• Defended trucking companies in multiple million dollar claims litigation in multiple states
• Defended national retailer in employment related litigation in multiple states
• Headed legal team representing workers' compensation administrator in federal lawsuit alleging breach of fiduciary duty, professional negligence and breach of contract involving the management of national trucking companies' self-insured workers' compensation pooling fund. After taking over the defense of the case from former counsel and filing dispositive, expert baring and spoliation motions, case settled on very favorable terms.
• Successfully represented minority partner in partnership dispute involving $100 million indoor mall development. Litigation spanned two states and resulted in sale of the mall and related properties, generating millions of dollars for the client.
• Headed team of attorneys prosecuting complex antitrust action involving plasma torch cutting parts pending in federal court. Responsible for extensive e-discovery and pretrial discovery.
• Successfully represented deceased doctor's estate in complex partnership dispute and breach of contract actions against doctor's former partners and a major medical organization
• Served as first chair trial counsel for lease dispute involving national retailer. Obtained favorable verdict for client, including injunctive relief and reimbursement of attorney fees. Representation continued through appeal, which affirmed the trial verdict and awarded additional reimbursement of attorney fees.
• Served as trial counsel for class A railroad in six-week jury trial involving trespassing minor whose leg was traumatically amputated. Case resulted in a hung jury and then settled on favorable terms for client.
• Served as first chair trial counsel for non-complete injunction litigation pending in federal court
• Served as first chair trial counsel for multi-million dollar class action lawsuit pending in federal court, handling all aspect of case through class certification and summary judgment
• Defended chemical solvent manufacturer in products liability action involving flash fire causing severe injuries to Plaintiff
• Defended psychiatrist in medical malpractice action alleging failure to diagnose brain tumor causing blindness and severe personality change
• Defended property owner in fire damage suit alleging more than $800 million in damages as a result of the destruction of a business record storage facility
• Defended local grocery chain in numerous construction and personal injury lawsuits
• Defended multiple physicians and hospitals in medical malpractice actions
